Herein lie the rules that preside over our websites. They are absolute, non-negotiable and subject to our interpretation. They may be changed at any time without prior notice. If you do not agree to them then we prohibit you from using our websites.
The phrase "use of our websites"/"using our websites" includes viewing, visiting, downloading, accessing, purchasing from or interacting with any of our websites.
The phrase "we"/"us"/"our company" refers to FyberSearch and all of its property (not limited to its websites).
The phrase "you" includes any legal entities you represent as part of your use of our websites.
The phrase "information you provide us" includes information you submit to us manually and information you submit to us automatically as a byproduct of using our websites (such as your computer's IP address, web browser and cookie data).
Presiding Rule #1. All information that you provide us is to be accurate and belong to you.
Presiding Rule #2. You are not to disobey any laws that you are subject to in the course of using our websites. This includes local laws such as those of your country, state/province, city, county, etc.
Presiding Rule #3. If you are subject to any laws that disapprove of a specific specific use of our websites then we also prohibit you from that use of our websites as well as any other use of our websites.
Presiding Rule #4. No violation of any law on your part is the fault, liability or responsibility of our company. It is your obligation to compensate us for any damage (financial or otherwise) done to our company as a consequence of you breaking a law.
Presiding Rule #5. The use of our websites is not guaranteed and there will be no compensation if they become unavailable or dysfunctional.
Presiding Rule #6. Some of our websites advertise the completion of a service within a specific timeframe. That timeframe is the standard but exceptions may be made under certain circumstances. Such exceptions may be made at our sole discretion for undisclosed reasons and are not grounds for any refunds or service quality complaints.
Presiding Rule #7. We are not at fault, liable or responsible for the use of our websites not matching your expectations. We will not compensate you if your expectations are not met and we will not debate the legitimacy of your expectations.
Presiding Rule #8. The decision to use our websites is yours along with any effects you believe to be caused by your use of our websites, including effects you believe to be negative, damaging or undesirable. This includes any effects that you perceive to be due to a compromise in our security. Any such effects are not our fault, liability or responsibility and you shall receive no compensation from us for them.
Presiding Rule #9. Any dispute you have with another user of our websites is between you and them. It does not involve us and it is your obligation to compensate us for any damage (financial or otherwise) done to our company as a result of your dispute.
Presiding Rule #10. You will resolve any dispute you have with us by communicating with us. If you fail to resolve your dispute this way you will participate in mediation or arbitration (subject to our approval of the mediator or arbiter chosen and subject to our willingness to engage in mediation or arbitration for the specific dispute). If you fail to resolve your dispute this way then litigation will take place in King County, Washington. You will pay the costs that both of us will incur to resolve your dispute. You will pay our costs within 3 months of us incurring them, subject to a 5% per month penalty for each late payment.
Presiding Rule #11. A court finding a section of one of these rules unenforcible within a specific jurisdiction does not negate the authority of that section nor does it negate the authority, applicability and enforceability of that rule.
Presiding Rule #12. A court finding a section of one of these rules unenforcible within a specific jurisdiction does not compromise the authority, applicability and enforceability of that section and that rule in every other jurisdiction.
Presiding Rule #13. A court finding a section of one of these rules unenforcible within a specific jurisdiction does not impact the authority, applicability and enforceability of the remaining sections and rules.
Presiding Rule #14. All refunds are subject to our approval.
Presiding Rule #15. It is not our fault, liability or responsibility to configure your web browsing habits to match your desired privacy level. We will not compensate you for any consequences to your privacy that you believe to be caused by your use of our websites.
Presiding Rule #16. The Anti Counterfeiting Clause is part of these presiding rules as is to be treated as such.
Presiding Rule #17. The Confidentiality Clause is part of these presiding rules as is to be treated as such.
